TERMS & CONDITIONS
Everyone has to have them!!! We at Perfect Day Tours SA aim to provide the best service and experience we can and will do our utmost to achieve this. The below terms and conditions are the legal side of our business that we adhere to and detail in every effort to be fair and transparent.
In this document, "you" and "your" include the lead-named person on the booking (who must be at least 18 years old at the time of booking) and all persons on whose behalf you make a booking.
The contract between us:
1.1 Our tours and services vary however, whatever tour or service you choose, the terms of this contract will apply unless we indicate otherwise.
1.2 The contract between us comes into existence when you make a booking. You will have undertaken to pay for your tour / service and we will have undertaken to provide you with the tour or service you have chosen.
1.3 When you make a booking with us, whether or not through our website, you have the benefit of our full compliance with the Competition and Consumer Act 2010.
Payments
2.1 All prices quoted on the website or via your enquiry are in Australian Dollars and are the current prices. These prices are subject to change but the price you pay when you book will be honoured.
2.2 If for any reason we are unable to accept your booking and you have paid online, we will of course return your payment to you immediately.
2.3 Tour prices quoted online include what is specified in the description. All tour prices quoted are per person unless otherwise stated - as is the case with the ‘Your Way’ tour in which an hourly rate has been quoted.
2.4 Any private arrangements for a tour or service will be quoted in writing and must be accepted in writing.
2.5 Tour / service prices do not include the following:
2.5.1 Insurance for any personal items that you bring with you
2.5.2 Any items that are not specified in the tour inclusions. This can include wine / beer / gin / produce purchases that you may choose to make during the day. Please also note, whilst small purchases can be accommodated in our tour vehicle, you will need to organise delivery for any larger orders.
2.5.3 Tips. Tips are not included in the pricing and whilst we welcome them, they are not mandatory. We also welcome your reviews and feedback.2.6 Promotions
2.6.1 From time to time we will offer promotions which can include discounted pricing or an extra service. Promotional codes will be provided for this and can only be redeemed at time of purchase and within the specified time frame.2.7 We will accept payments from Visa or Mastercard.
Guests
3.1 If you make a booking on behalf of others as well as yourself, you guarantee that you have the authority of each of those other people to enter into the contract and that you and they have agreed to be jointly and severally liable to us. You now accept personal liability for the acceptance and compliance of each of those people, with these contract terms.
3.2 Children / Persons under 18
We can accommodate guests under 18 on a private tour only. All guests under 18 must be accompanied by a parent or guardian who assumes sole responsibility for their supervision. Bookings for Guests under 18 must be made directly with Perfect Day Tours SA and pricing will be adjusted accordingly.Minimum / Maximum Guests
4.1 We require a minimum of 2 guests and a maximum of 7 guests for our advertised bookings.
4.2 We can arrange tours / services for larger groups of 7 but this will be via a private booking.
Changing or cancelling your booking
5.1 We will always do our best to help you with any changes you need to make to your booking. Please reach out to us if your circumstances change to see how we can best help you by either rescheduling or modifying the tour or service.
5.2 In the event that you need to cancel your booking, the following charges will apply:
Cancellations within 48 hours of departure for your tour or service will incur the full fee of the tour or service.
Cancellations outside of the 48 hours of departure for your tour or service will not incur any penalties and any monies paid will be refunded in full within 14 days. (If a private agreement has been made in writing and accepted by both parties, the private agreement will override this clause)Note: we strongly recommend that you take out holiday insurance which covers the cost of cancellation.
If we cancel your tour or service
Sometimes things are out of our control. On those very rare occasions we may need to cancel or adjust a tour or service. If that happens the following terms apply:
6.1 We will always inform you as soon as possible about any change. If that happens you may:
6.1.1 accept the change; or
6.1.2 accept our offer of an alternative; or
6.1.3 cancel your booking, where upon we will give you a full refund of all money paid.
6.2 We reserve the right, at our discretion, to cancel any tour or service due to unlawful or unruly conduct. This is not limited to and can include aggressive and offensive behaviour. If a guest is considered overly inebriated, we reserve the right to remove this guest from the tour. If these behaviours are displayed during a tour and the tour cannot continue, no refunds will be provided.
Itinerary Adjustments
7.1 Itinerary adjustments can be made at the discretion of Perfect Day Tours SA. Sometimes the venues on the itinerary can be closed due to
private events or the sightseeing destination may be unavailable due to unforeseen circumstances. We will always provide a similar venue or experience and will advise you of any major changes that we need to make.Confirmation
8.1 Confirmation of bookings will be provided via email from Perfect Day
Tours SA. This confirmation or identification will need to be provided at the start of your booking or service.The Tour or Service – Pick Up & Drop Off
9.1 Tours will begin at the pre-arranged time and at the destination which is confirmed via the booking confirmation. Please ensure you are ready at the pre-arranged time as this can have a big effect on the day. If your booking needs to be adjusted for any reason, please let us know so we can make the adjustments accordingly.
9.2 If for any reason we are unable to locate you at the pick up destination at the pre-arranged time, we will try to make contact with you via the mobile number provided at the time of booking. If we are unable to do so within 15 minutes of the departure time, this will be deemed as a last minute cancellation and no refunds will be issued.
9.3 After our tour or service concludes, we will return you to your pick up destination unless other arrangements were made prior in writing.If you have a complaint….
10.1 It is our intention to make sure we do everything in our power to provide the tour and service we have promised and to ensure your experience is wonderful.

11.1 If we fail to provide the Tour or service set out on our website or in our brochure and to which these terms apply, please let us know in writing and we will endeavour to make amends.
However, we are not liable if any failure is due to:11.1.1 your own carelessness or negligence in any aspect of your behaviour whilst on our tour or service
11.1.2 medical emergencies;
11.1.3 laws, culture and standards of service and behaviour in any venue or place we may visit
11.1.4 changes we reasonably make to an itinerary
11.1.5 any other unusual and unforeseeable circumstances beyond our control;
11.1.6 specific event or series of events which we or our contractors or providers could not reasonably have foreseen or prevented;
Terms and conditions of third party providers
The venues that we take you to are controlled by third parties and not directly by us. Each has their own terms and conditions. We do not accept any liability for your breach of their terms and conditions.
Privacy / Photos
13.1 Any personal information that we collect from you may be used for any purpose associated with the tour or service. This information may be disclosed to our partners and service providers. These details include your contact details (name / address / telephone number / email address / age).
13.2 We also reserve the right to send you marketing material unless you specify otherwise.
13.3 Photos – we will take photos on the day of your tour. We reserve the right to use these images for marketing purposes. You can advise us prior to the tour in writing if you would prefer not have photos taken.
Miscellaneous matters
14.1 If any term or provision of this agreement is at any time held by any jurisdiction to be void, invalid or unenforceable, then it shall be treated as changed or reduced, only to the extent minimally necessary to bring it within the laws of that jurisdiction and to prevent it from being void and it shall be binding in that changed or reduced form. Subject to that, each provision shall be interpreted as severable and shall not in any way affect any other of these terms.
14.2 Any obligation in this agreement intended to continue to have effect after termination or completion shall so continue.
14.2 No failure or delay by any party to exercise any right, power or remedy will operate as a waiver nor indicate any intention to reduce that or any other right in the future.
14.3 The parties agree that electronic communications satisfy any legal requirement that such communications be in writing.
14.5 For the purposes of the Privacy Act 1988 each party consents to the processing of his personal information (in manual, electronic or any other form) relevant to this agreement, by the other
14.6 In the event of a dispute between the parties to this agreement, then they undertake to attempt to settle the dispute by engaging in good faith with the other in a process of mediation before commencing arbitration or litigation.
14.7 So far as the law permits, and unless otherwise stated, this agreement does not give any right to any third party.
14.8 The validity, construction and performance of this agreement shall be governed by the laws of State of South Australia and the parties agree that any dispute arising from it shall be litigated only in that State.
